NNN - the author of this post is correct. From the opinion written in the link above “ Englehardt wrote. ‘EMTALA does not mandate medical treatments, let alone abortion care, nor does it preempt Texas law.’ ” The ruling makes it difficult to determine legality of abortion. The Court only affirmed there was no abuse of discretion in granting an injunction, and that the injunction was tailored only to the underlying case.
