The judge has not changed the law. The judge instructed the jurors that they do not need to agree unanimously on what the crime was that the falsified records were used to cover up (tax/election fraud), but they must still be unanimous for the falsifying records charge. [Link]

It doesn't quote NY law or statute. The time to prosecute a misdemeanor expired in 2019 the only way to bring the misdemeanor to trial is to prove an underlying felony. It's this felony that has to be proven beyond a reasonable doubt [Link] New York State Code Section 30.10(2)(a)

The judge is suppose to be unbiased. The wording suggests the judge is trying to lead the jury into an answer he wants to happen. In other words the judge decided he's already guilty and asking jurors to decide which things he's guilty of rather than allowing an unbias ruling.
