It doesn't quote NY law or statute. The time to prosecute a misdemeanor expired in 2019 the only way to bring the misdemeanor to trial is to prove an underlying felony. The judge is suppose to be unbiased. The wording suggests the judge is trying to lead the jury into an answer he wants to happen.
