The 60 day guideline only applies to new actions. Smith filed superseding indictments which replace the original indictments. There are no new charges and this case is not new. Therefore, the 60-day guideline doesn’t apply. [Link]

[Link] It quotes deputy AG Yates saying that if you don't need to take action that impacts an election 60-90 days out you should avoid it. Smith had 6 months to file a superseding indictment and more time to appeal the documents case. Clear election interference.
