The FAA does not license Boeing's Starliner spacecraft while it is under development, therefore it can't fine the company for something it does not handle. NASA already handles Starliner. One can see what missions have been licensed by the FAA in the agency's website: [Link]

The proposed note's legal analysis is (mostly) correct regarding why regulations don't require Boeing to be fined. However, a plain reading of Elon's tweet is that he is expressing an opinion that the existing laws/regulations are bad as they punish SpaceX and not Boeing. [Link]

The FAA have the power to fine boeing for human endangerment and should have done just as they did in this case. [Link] the FAA clearly have a problem with SpaceX and that’s not bias that is stating the facts laid on paper
