5240.01 does not do what RFK claims. Guidance from the Kansas Adjutant General's Department states that " [the directive] enables DoD to continue to conduct authorized intelligence activities in a manner that protects the constitutional and legal rights of U.S. persons." [Link]

DoDD 5250.01 was updated in 2017, RFK is referencing DoDD 5240.01 effective Sept, 2024. The updated directive includes language in Section 3.3.a(2)(c) that permits use of legal force in cases of imminent threats & national security emergencies per oversight of DoDD 5210.56 [Link] [Link] [Link]
