Nintendo has not officially stated that emulation itself is illegal, but they assert that emulators bypass security features, which can violate the DMCA. The legality issue mainly applies to using emulators to circumvent protections on copyrighted games . [Link]

Misleading/Missing Context. Nintendo isn't saying emulation is illegal; rather, they discourage the use of emulation because it typically involves sharing unauthorized copies of their games (ROMs), but their primary concern is piracy, not emulation itself. [Link]

Nintendo makes reference to 2 actions in their question, the development of emulators, and the distribution of Nintendo ROMS. While the former is legal, the latter is not. Emulation is only legal if you are able to obtain the ROMS yourself from a copy of the game you own. [Link]

Leading note is incorrect. One does not need to dump the ROM themselves, simply owning the physical game media is enough to have valid claim to the ROM regardless of how it was acquired. [Link]
