The Governor is stating that criminals will be arrested and prosecuted. That is misleading. It's only a misdemeanor for theft under $950. As a result police don't even show up because they can't arrest and the courts will not prosecute. [Link]

Looting in CA has been downgraded to a misdemeanor in all cases where theft is under $950 (formerly $400) requiring no jail time, allows for multiple separate offenses and charges for each claimant to keep the charges at misdemeanor level, and is rarely prosecuted. [Link]

By definition theft under $950 was “decriminalized” in California for 1 decade from 2014 -2024. The penalty was brought down to a misdemeanor from previously being a felony charge. Decriminalize: “ to remove or reduce the criminal classification or status of” [Link]

NNN: CA voters passed Prop 36 which allows DA’s to prosecute a felony charge for theft under $950. [Link] Also Newsom signed into laws harder penalties for theft crimes in August 2024. Arrests were made and people prosecuted. [Link]

California reduced the penalties for all theft crimes including loot to a misdemeanor if under $950 with Prop 47 in 2013 that Gavin Newsom supported. In 2024, voters repealed much of that with Prop 36. Governor Newsom campaigned against Prop 36. [Link] [Link]

NNN - all of the community notes above ignore the fact that looting is covered underneath its own section under state code. Regardless of penalties, theft is still illegal. Stop using community notes for your political bias. [Link]

For context, California led by Democrat super majority has not prosecuted criminals looting retail stores and has been known to be soft on criminals. “On papers” it’s still a crime, but it’s what political classes say & do, to gaslight and manipulate bourgeoisie. [Link]
