NNN. It’s clear the Vice President stated it’s an “idea” that the President chooses their cabinet, not the constitutional law. An idea, would be interpretation, which would be his opinion. If you believe his interpretation is incorrect, take it to the comments.

There is reasonable debate about what the words "advice and consent" mean. If you want to argue about how the Constitution should be interpreted, go to Law School, pass the bar, find a client with standing, and petition the Supreme Court to hear your case.
