Performance in matters of resolving pending cases is very poor.More than 5 crore cases are pending in judiciary.Means on an average 10 crore families & 50 crore people are victim of lethargic judiciary.No doubt judiciary is worst pillar of Indian state.

"हमारे लोग" का अर्थ स्पष्ट नहीं है।अर्थ यदि केवल कांग्रेस से है तो यह दावा भ्रामक है।आरएसएस 1925 में गठित हो चुका था।कांग्रेस के अलावा भी बहुत से दल थे जो स्वतंत्रता संग्राम में सतत संघर्ष कर रहे थे।'संविधान का दुरुपयोग' का आरोप एक ग्रे एरिया है,कारण स्पष्ट नहीं किया गया है। [Link]

Indian state in the terms of polity means trio of executive, legislative and judiciary. It's not equivalent to the government of India rather to the republic of India. That's why such declaration is fit for putting sedition charge on the claimer.
