This is a bill to amend the sentencing provisions of the Criminal Code of Canada. It would add as an aggravating factor on sentencing, the fact that in committing an offence, the offender knew the victim was pregnant and the offence caused physical or emotional harm. [Link]

Bill C-311 is a sentencing bill. It does not bestow legal protections to the fetus. It would make an assault on a pregnant woman, knowing she's pregnant, statutorily aggravating. The victim is the woman, not the fetus. This is not an abortion bill. [Link]

The SCC struck down the mandatory reporting provisions for sex offenders in Oct, 2022. The amendment sought would not be Charter compliant. It would be doing exactly what the SCC says you can't. [Link] [Link]
